Advertising Terms and Conditions

This Agreement governs the terms and conditions applicable to Advertisers who choose to advertise on any entity operated by DealNews.com, Inc. ("DealNews"). By participating in the Service, you acknowledge and agree to be bound by these terms and conditions.

  1. Modification and Termination of Content
    DealNews reserves the right, at its sole discretion, to restrict, suspend, or terminate any information, graphics, or other material (collectively, "Content") provided by or for any Advertiser at any time, for any reason, and without prior notice or liability.
  2. Accuracy of Content
    While DealNews may correct errors upon notification, DealNews makes no representations or warranties regarding the accuracy of the Content. DealNews shall not be liable for any damages, including loss of money or reputation, arising from errors in the Content, even if such errors are introduced by DealNews.
  3. Service Warranty
    DealNews does not warrant that the Service will be uninterrupted or error-free, nor does it guarantee specific results from the Advertiser’s use of the Service. DealNews shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service. 
  4. Expiration
    The services provided on each of the line items sold must be published within 90 days from the date of the signed contract. If the services are not used within that time they will be considered canceled, null, and void. 
  5. License Grant
    Subject to the terms and conditions of this Agreement, the Advertiser hereby grants to DealNews a limited, non-exclusive, non-transferable, royalty-free license to use the Advertiser’s trademarks, trade names, service marks, logos, and copyrights (collectively, "Advertiser Marks"), as well as the copy, product images, and product logos displayed on the Advertiser’s website (collectively, "Advertiser Content"), on the DealNews Websites under this Agreement. The Advertiser represents and warrants that it possesses, and will maintain throughout the term of this Agreement, the necessary rights and authority to grant DealNews the licenses and usage rights to the Advertiser Marks and Advertiser Content as specified herein.
  6. Payment Terms
    Payment is required before the provision of the Service. If the Advertiser fails to make payment in full by the due date, DealNews reserves the right to immediately suspend ad displays, resell the ad space, and place the Advertiser’s account in suspension. A $100 reactivation fee will be applied if the Advertiser’s campaign is suspended. This reactivation fee must be paid in addition to the outstanding account balance before the account will be reactivated.
    • Cancellation
      If the Advertiser wants to cancel their contract for the services sold, it must be requested 2 days before the date of service. If items on the contract have been published, these cannot be canceled, and the Advertiser is responsible for paying for the services rendered and associated processing fees.
    • Refunds
      For the Advertiser to request a refund this must be done after the payment has been fully received. Refunds can be requested immediately, but there may be a delay based on the transaction processing rates. Any items purchased on the contract that have been published are excluded from the refund, and a partial refund will be granted for all items not published. The refund will not include any associated processing fees.
    • Collection and Legal Action
      If the Advertiser’s account balance remains unpaid after forty-five (45) days past due, DealNews reserves the right to refer the account to an attorney and/or collection agency and pursue all appropriate legal actions. If payments are overdue from other insertion orders or invoices for any company associated with the Advertiser, this insertion order may be withheld until payment is made. Payments may be applied to any past-due balances.
    • Legal Fees and Governing Law
      In any legal proceeding to collect an overdue account, the prevailing party shall be entitled to recover reasonable attorney’s fees, including those anticipated for enforcing any judgment. Legal proceedings shall be governed by and enforced in accordance with the laws of the State of Alabama, with jurisdiction and venue exclusively in Madison County, Alabama.
    • Collection Costs
      If this contract is delivered to a third party for collection, the Advertiser shall be responsible for all associated costs.
       7.  Amendments
DealNews reserves the right to modify any or all terms of this Agreement at its discretion, with or without prior notice.
      8.  Additional Opportunities
While DealNews may offer additional opportunities to Advertisers, it makes no guarantees regarding such offers and provides no warranty, expressed or implied, that this Agreement guarantees any specific publication of deals.
     9.  Supersession
These terms and conditions supersede any verbal, electronic, or other terms provided by DealNews, except for other insertion order agreements.
